Twitter India is an independent organization as its parent company Twitter does not have a single share in it, Twitter India CEO Manager Maheshwari said in the Karnataka High Court on Thursday.
The statement was made during a hearing by a single judge on Maheshwari’s application, in defiance of a notice issued by Uttar Pradesh police, demanding his appearance as part of its investigation into a social media video posted by a user on Twitter.
Justice G Narendra’s order is expected to be announced on Friday.
While Justice Narendar wanted to know if the US mainstream Twitter could be called a parent company, Maheshwari’s lawyer CV Nagesh said, “Twitter is a parent company.
We have nothing to do with it (Twitter Inc). It (Twitter India) is an independent and independent organization.”
When a judge asked about the promoters and patterns of shares in Twitter India, Nagesh said Twitter India is a company that only deals with Twitter.
The judge then pointed out that there is no such thing as a partner company.
In general terms it is called a sister company or affiliated company, depending on the share of shares and a memorandum of association.
In this regard, Nagesh said “Let me record that Twitter USA (Inc) does not have a single share in Twitter India. That is why I add that it is something completely different.”
P Prasanna Kumar, a lawyer for Gaziabad police, said Twitter would face “the consequences of claiming to know who Twitter India is”.
Kumar said “My instructions say 99 percent of the company’s shares are on Twitter.”
“All our partners in the petition have represented Twitter India, as well as Twitter before the central government to this day,” Kumar said.
He added that “unless Twitter officials in India India are connected”, the Twitter board. it would not authorize its Twitter India staff to represent them before central government agencies.
Justice Narendar stressed that the board of directors could authorize anyone.
During the controversy, Nagesh offered to put a memo on the record on Friday that Twitter USA was not even a shareholder.
Explaining the shareholding pattern, he said Twitter International Company, headquartered in Ireland, has 9,999 shares, while Twitter Netherlands has one share.
However, it is Twitter that is running the platform.
Ghaziabad (Uttar Pradesh) police issued a notice under CrPC Section 41-A on June 21, asking Maheshwari to report to the Loni Border police station at 10.30am on June 24.
He then sued the Karnataka High Court as he lived in Bengaluru in Karnataka.
On June 24, the Supreme Court, by an interim order, restrained the Ghaziabad police from taking firm action against him.
Justice Narendar also held that if the police wanted to investigate him, they could do so in a practical way.
Ghaziabad police on June 15 booked Twitter, Twitter India, The Wire news website, journalists Mohammed Zubair and Rana Ayyub, with the exception of Congress leaders Salman Nizami, Maskoor Usmani, Shama Mohamed and writer Saba Naqvi.
They were booked through a video distribution in which old Abdul Shamad Saifi claimed to have been beaten by some of the young men, who also asked him to sing “ Jai Shri Ram ”.
