Supreme Court refuses to suspend publication of ‘Why I Killed Gandhi’ on OTT

New Delhi: The Supreme Court on Monday refused to consider a writ petition seeking a stay on the release of the movie ‘Why I Killed Gandhi’ on the over the top (OTT) platform ‘Limelight’ and asked the petitioner to apply to the relevant High Court on the matter.

Granting freedom to the petitioner to petition the High Court, a panel of Justices Indira Banerjee and JK Maheshwari observed that a written petition under Section 32 can only be filed where a fundamental right has been violated. “There is no fundamental right of the petitioner which appears to have been violated. Thus, this plea cannot succeed. However, it appears that the petitioner is a citizen may have serious cause for concern here. The petitioner is free to apply to the High Court under Section 226,” the court said.

Seeking to remove all content of the controversial film from all online platforms, petitioner Sikandar Behl, through lawyer Anuj Bhandari, also requested a ban on any exhibition or publication of the film or its content from any way on any OTT platform or social network. media. If the release and exhibition of the said film is not stopped, it would irreparably tarnish the image of the Father of the Nation and cause public unrest, hatred and discord, the plea reads.

He also highlighted the need for content regulation of OTT platforms.

In the two-minute twenty second trailer of the film, an attempt was made to blame Mahatma Gandhi for the partition of India and the atrocities against Hindus in Pakistan, and thus an attempt was made to justify the murder of the Mahatma, he said.

The film, which is set to release on various OTT platforms on January 30, the anniversary of Mahatma Gandhi’s assassination, has sparked huge controversy.
