Rejecting the request filed by the teaching and non-teaching staff of these educational institutions, a bench of Judge Rajesh Singh Chauhan declared that on December 23, 2016, the government of the day decided to provincialize these seven educational institutions by as a code of conduct for the 2017 assembly elections. It was hastily taken a few days before its implementation and the necessary procedure was not followed for it.

The magistracy indicated that the then chief minister (Akhilesh Yadav) had approved the exercise of the provincialization of the seven educational establishments concerned on the last date of the elections, either March 8, 2017 or March 14 after counting of the votes. voice. It was all done in such haste that the motive behind it is suspect.

2016 employees did not receive a salary

In this case, the teachers and non-teaching staff of these educational establishments had filed a petition with the court saying that they served in these establishments but that they had not received a salary since December 23, 2016. The The petition stated that the state government would have taken possession of all the property of these educational institutions under the law.

The court concluded that the intention of the government of the day to provincialize these institutions was not sacrosanct. For this reason, the court upheld the decision of the government led by Yogi Adityanath on February 13, 2018.
