Cancel CBSE Compartment Exams- New Delhi: A petition has been filed with the Supreme Court seeking a review of the June 22 order that approved the CBSE’s decision to cancel the regular Class 12 exams and its objective assessment program. The request for review requests the cancellation of the examinations offered for class 12 CBSE for private / compartments / Patrachar students.
Declaration of the results of the pupils of class 12 CBSE Private / Compartment / Patrachar using the objective evaluation formula adopted for regular pupils before July 31.
A public hearing has been requested for the plaintiffs to make submissions on important questions of law and fact that could not have been brought before the Court sooner.
Position statement of the petitioner:
According to the petitioner, the exam has been requested so that no prejudice is caused to the students upon admission to the next higher classes in India and abroad at the next academic session.
This category of students has already lost a precious year of study and now, due to the “discriminatory policy” of the CBSE and Article 29, they will be forced to lose another year of study.
The advocacy points out that the exams for these students are held with regular students every year and that the results are also reported together. “
The pupils of the 12th class of Patrachar are a separate category of pupils and are not repeaters or compartment pupils. Patrachar students are students who have changed their course from science or business to arts from grade 11 to 12 or students who are preparing for competitive exams with school exams.
Which Supreme Court observed?
The Supreme Court, while approving the objective assessment system of the CBSE for ordinary class 12, had observed that the system provided that an examination would be duly organized during which all candidates in the compartment could present themselves as private candidates. .
The Chamber had also noted that such an exam would be held between August 15 and September 15, 2021 and that the results would be declared at the earliest so that even these students would be able to continue their studies, if they so wished.
The Chamber had noted that Article 29 of the CBSE Scheme provided for this possibility and, consequently, the apprehension maintained by the lawyer Abhishek Chaudhary, who appeared for the private, the patrachar and the second compartment did not deserve to be taken into account.
“The present regime provides that the examination will be duly organized in which all these candidates can appear as private candidates and this examination will be organized between 15.08.2021 and 15.09.2021 and the results will be declared at the earliest so that even these students are able to continue their studies, if they wish. As indicated in article 29 of the C.B.S.E. Scheme, it foresees this eventuality and, consequently, the apprehension maintained by Me Abhishek Chaudhary, learned counsel, does not merit consideration ”, had observed the Supreme Court in the order of June 22.
