The Supreme Court bench headed by Justice AM Khanwilkar heard the appeal against offline board exam 2022. Notably, this plea was filed by students in 15 states seeking alternative assessment methods for the upcoming board exams for grades 10 and 12 instead of holding the physical exam. Last year, several boards, including the CBSE, CISCE, NIOS, and other state boards, decided to assess students based on alternative assessment criteria. Pupils were promoted to the next class based on their marks in the internal examinations.

It is to be mentioned here that the Brief Petition is filed by Child Rights Activist Anubha Shrivastava Sahai, who seeks directions from the Court for State Boards, CBSE, ICSE, NIOS to set aside or set up any internal evaluation program. The petitioner stated in the Supreme Court’s written petition that the Council remains a silent spectator of the current situation and has taken no action with respect to thconcerninge review and declaration o the final outcome for millions of students in the classes X and XII. The petitioner informed the court that some state boards have released the exam schedule and others are still waiting.

The Central Board for Secondary Education (CBSE) has announced the dates for the second term class 10 and 12 exams. Semester 2 exams will take place from April 26th. Meanwhile, the Council of Indian Schools Certificate Examinations (CISCE) is likely to hold the ICSE Class 10 and ISC Class 12 exams during the last week of April. The detailed schedule, CISCE said in a statement, will be released shortly.

The petitioner also requested the UGC to set up a committee to declare the date of admission to various universities and an assessment formula for Class XII students who wish to continue their education in non-vocational courses by taking a test of aptitude or another mode. assessment within a time and a deadline.

“Students in all states are very worried about conducting the 10th and 12th board exams due to the high rate of
growth of COvID-19 cases nationwide as well as the strong possibility of a 3rd wave which will affect students very badly, and also due to the incompleteness of classes in this pandemic situation. In most states, during the lockdown period from June to December 2020, no classes were offered to students. Nearly 98% of colleges/schools in all states had not held any online classes for students during this time. Looking into the matter, the state government and education department has declared 100 days of offline classes for students and will conduct exams after 100 days of online classes. The government has said students must bring a “CERTIFICATE OF NO OBJECTION” signed by parents to join offline lessons. But most parents have not been able to allow their child to attend offline lessons during the pandemic,” states the petition filed through registered attorney Prashant Padmanabhan.

“The petitioners, therefore, argue that subjecting children to the examination and carrying out the examination while the wave of Covid-19 is still high, with the number of infected patients and deaths increasing day by day as we see unprecedented mortality figures, as experts predict that the third wave of resurgence likely to affect mainly children and young people, it will be a violation of their right to life”

Considering that the MP government is starting the board exams for X and XII classes from 17th February, an urgent interim measure for issuing instructions to the Madhya Pradesh government not to hold the board exam for classes X and XII, until the final outcome of this brief petition was also solicited.
