Bombay HC Extends Stay On Summons To Alia Bhatt

Bombay: Bombay High Court on Wednesday extended stay of proceedings in defamation suit against Bollywood actor Alia Bhatt and writers S Hussain Zaidi and Jane Borges, in upcoming Hindi film ‘Gangubai Kathiawadi’.

A single bench from Judge SK Shinde extended the interim suspension the HC granted in August this year.

Bhatt and the others had moved the HC against the subpoena issued against them earlier this year by a district court after a certain Babuji Shah, who claims to be the adopted son of Gangubai Kathiawadi, alleged that parts of the film were defamatory and tarnished the image of his late mother, a powerful lady from Kamathipura, the red light district of Mumbai, in the 1960s.
Judge Shinde said on Wednesday that Shah had so far failed to prove that he was Kathiawadi’s legally adopted son.

The HC said the matter deserved to be considered since, in a libel action, only relatives or family members have the right to lodge a complaint.

“The matter deserves attention because the right to complain against defamation is limited to family members or close relatives, so it was important for Mr. Shah to prove that he was one of them,” he said. declared the HC.

The court declared a prima facie case (prima facie) that an application to grant interim relief to Bhatt and the others had been made and stayed the proceedings and the summons against them until a new hearing of their plea. in front of the HC.
